Canada Humanitarian and Compassionate Grounds
Foreign nationals who live in Canada but not generally be admissible or do not fulfill the conditions set by the Immigration and Refugee Protection Act (IRPA) or the Immigration and Refugee Protection Regulations (IRPR) can apply for a permanent resident visa based on Canadian humanitarian and compassionate (H&C) grounds.

Ineligibility for Humanitarian and Compassionate Grounds?
Individuals who do not have any legal status in Canada can be eligible for humanitarian and compassionate grounds if they have set themselves in Canada in the following way:
- Family ties to Canadian citizens or permanent residents
- Work in Canada usually without a valid Canada work permit visa
- Studying in Canada normally without a valid Student Permit visa
- Volunteer employment in Canada
- Enhance English or French language skills
- Assets and savings in Canada
- Social Ties to Canadian Communities
An individual may not be eligible for humanitarian and compassionate grounds if they have:
- Applied for permanent residency status from outside Canada
- Applying for a temporary resident visa (TRV)
- Applied more than once for humanitarian and compassionate
- Applied for humanitarian and compassionate (H&C) based due to certain risk factors such as persecution, loss of time, or cruel activities
- Pending refugee claim
- Prior rejection from the Immigration and Refugee Board (IRB) in the last 12 months

After applying for permanent residence status on Humanitarian and Compassionate grounds, there are two possibilities for your applications:
- Refusal of H&C Application
- Approval of H&C Application
