Humanitarian and Compassionate

Foreign nationals who live in Canada but not generally be admissible or do not fulfil the conditions set by the Immigration and Refugee Protection Act (IRPA) or the Immigration and Refugee Protection Regulations (IRPR) can apply for a permanent resident visa based on Canada’s humanitarian and compassionate (H&C) grounds.

Humanitarian and Compassionate Assessment

The Canada Humanitarian and Compassionate application assesses under certain circumstances. The individual needs to inform the Canadian government about the situation of danger, hardships, and struggle if they stay or return to their country. The decision will be based on the current circumstances of an applicant and whether these particular circumstances justify an H&C consideration. It is important to note that permanent residence status in Canada on H&C grounds grants only under certain exceptional cases. The application process is considerably longer and can take ages to conclude.

After applying for permanent residence status on H&C grounds, there are two possibilities for your applications:
  • Refusal of H&C Application: If your Canada Humanitarian and Compassionate Application gets rejected, you will have 15 days to apply for a review of the decision to the Federal Court of Canada. The decision will depend on the circumstances of your case.
  • Approval of H&C Application If your H&C Application approves, you will be required to pass the medical and police examination and get your Permanent Residence Card (PR Card).

Individuals who do not have any legal status in Canada can be eligible for H&C grounds if they have set themselves in Canada in following way:
  1. Family ties to Canadian citizens or permanent residents
  2. Work in Canada usually without a valid Canada work permit visa
  3. Studying in Canada normally without a valid Student Permit visa
  4. Volunteer employment in Canada
  5. Enhance English or French language skills
  6. Assets and savings in Canada
  7. Social ties to Canadian communities
An individual may not be eligible for H&C grounds if they have:
  1. Applied for permanent residency status from outside Canada
  2. Applying for a temporary resident visa (TRV)
  3. Applied more than once for H&C
  4. Applied for H&C based due to certain risk factors such as persecution, loss of time, or cruel activities
  5. Pending refugee claim
  6. Prior rejection from the Immigration and Refugee Board (IRB) in the last 12 months.
